CIT reverses its earlier rulings and upholds Commerce's countervailable benefit findings in KG Dongbu Steel case
The U.S. Court of International Trade, in Slip Op. 26-130 in Court No. 22-00047, reversed its conclusions in KG Dongbu I, KG Dongbu II and KG Dongbu III to conform to the Federal Circuit's opinion in KG Dongbu IV, 181 F.4th 1335 (Fed. Cir. 2026), and held that Commerce's reconsideration of the first three equity infusions, its determination of a countervailable benefit and its finding that the benefit passed through on KG Consortium's acquisition were supported by substantial evidence and not contrary to law.
