Reg. 83636 (Oct. 17, 2024). In Slip Op. 26-79, Court No. 24-00263, Judge Gary S. The court sustained the Final Determination.
The U.S. Court of International Trade, in Slip Op. 26-71 dated July 1, 2026, denied the USW's motion for judgment on the agency record in Court No. 25-00004, sustaining Commerce's final affirmative antidumping determination on truck and bus tires from Thailand, 89 Fed. Reg. 83636. The union had argued that Commerce failed to explain why it did not apply an adverse inference to Prinx Chengshan Tire (Thailand) Co., Ltd.'s reporting of financial expenses when calculating the financial expense ratio. The court held that Commerce's decisional path was reasonably discernible and that the determination was supported by substantial evidence and in accordance with law.
