CIT dismisses pro se trade-agreement complaint for lack of subject matter jurisdiction
In re Raj K. Patel
The U.S. Court of International Trade dismissed Raj K. Patel's complaint for lack of subject matter jurisdiction in Slip Op. 26-132, Court No. 26-04703, and denied his motion to compel acceptance of the complaint as moot. Patel sought declaratory and equitable relief and $380 million in damages, alleging the United States violated trade agreements including GATT 1995, the USMCA and the U.S.-China Economic and Trade Agreement by preventing access to certain medical technologies. Judge Jane A. Restani held that the trade agreements he invoked are not a law falling under the court's residual jurisdiction under 28 U.S.C. § 1581(i), and the court found no other provision conferring jurisdiction.
