Gellert Global Group challenges Trump's 50% Canada tariffs at the CIT
Gellert Global Group filed suit at the U.S. Court of International Trade on October 20, 2026, asking the court to strike down the 50% tariffs on $20 billion of Canadian goods imposed under Section 338 of the Trade Act of 1930, block their collection and order refunds. The suit alleges Trump did not adequately identify Canadian policies justifying Section 338, that Section 301 of the Trade Act of 1974 supersedes it, and that tariffs were placed on products not tied to alleged discrimination and later expanded without the mandatory 30-day waiting period.
